1. Acceptance of Terms

By accessing and using DataMCP (“Service”, “we”, “us”), operated by Individual Entrepreneur Andrei Mironov, you (“User”, “you”) accept and agree to be bound by these Terms of Service (“Terms”).

2. Description of Service

DataMCP provides:

  • Database schema extraction and MCP integration for PostgreSQL databases
  • OpenAPI schema extraction and MCP integration for REST APIs
  • Real-time schema synchronization for AI coding tools (Cursor, Claude, v0, Lovable, etc.)
  • Public API endpoints for schema access
  • Version history and change tracking

3. User Accounts and Registration

  • You must provide accurate and complete information when creating an account
  • You must be at least 18 years old or have parental consent
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One person or entity may not maintain multiple free accounts

4. Acceptable Use Policy

You agree not to:

  • Use the service for any unlawful purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or other users’ data
  • Interfere with, disrupt, or overload the service or servers
  • Upload malicious code, viruses, or harmful content
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the service to compete with us or build a similar service
  • Share account credentials or allow unauthorized access
  • Violate any third-party rights or terms of service

5. Data Ownership and Security

  • Your Data: You retain full ownership of your database schemas and API specifications
  • Our Processing: We only extract metadata (table names, column types, relationships) - never your actual data
  • Security: We implement AES-256-GCM encryption and industry-standard security measures
  • Storage: Data is hosted on Supabase (US-based, GDPR-compliant infrastructure)
  • Access: We will never access, view, or use your data for any purpose other than providing the service

6. Service Availability and Support

  • Uptime: We strive for 99.9% uptime but do not guarantee uninterrupted service
  • Maintenance: Scheduled maintenance will be announced at least 24 hours in advance
  • Support: We provide email support with response times of 24-48 hours during business days
  • Limitations: We are not liable for service interruptions due to third-party services, internet outages, or circumstances beyond our control

Pro Plan ($10/month)

  • Unlimited database connections
  • Hourly synchronization
  • Unlimited schema history
  • Email support
  • 14-day free trial

Team Plan ($49/month)

  • Everything in Pro
  • Up to 10 team members
  • Real-time synchronization
  • Priority support
  • Custom integrations

Billing Terms

  • Subscription fees are billed monthly or annually in advance
  • All payments are processed through Stripe or Paddle
  • Prices are in USD and exclude applicable taxes
  • We may change pricing with 30 days advance notice
  • No refunds for partial months except as outlined in our Refund Policy

8. Free Trial and Refund Policy

  • Free Trial: Pro and Team plans include a 14-day free trial
  • Refunds: Full refund available within 7 days of initial payment for monthly plans
  • Annual Plans: Pro-rated refunds available within 30 days of initial payment
  • Cancellation: You may cancel your subscription at any time
  • Access: Service remains available until the end of your billing period

9. Intellectual Property

  • Our IP: DataMCP, our technology, trademarks, and content are our intellectual property
  • Your IP: You retain all rights to your data and schemas
  • License: You grant us a limited license to process your schemas solely to provide the service
  • Feedback: Any feedback or suggestions you provide may be used by us without compensation

10. Privacy and Data Protection

  • We collect and process data as described in our Privacy Policy
  • We comply with applicable data protection laws including GDPR
  • We use cookies and analytics tools as described in our Cookie Policy
  • You may request data export or deletion at any time

11. Termination

By You

  • You may terminate your account at any time through your dashboard
  • Upon cancellation, billing stops but service continues until period end
  • You may request data deletion after account termination

By Us

  • We may suspend or terminate accounts for violations of these Terms
  • We will provide 30 days notice for termination without cause
  • Immediate termination may occur for serious violations or legal requirements

Effect of Termination

  • Your access to the service will cease
  • We will retain data according to our Privacy Policy
  • Outstanding fees remain due

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • DataMCP is provided “as is” without warranties of any kind
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability is limited to the amount you paid in the 12 months preceding the claim
  • We are not responsible for data loss, business interruption, or lost profits

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your data or content

14. Dispute Resolution

  • Governing Law: These Terms are governed by the laws of Georgia
  • Jurisdiction: Disputes will be resolved in the courts of Georgia
  • Informal Resolution: We encourage contacting us first to resolve disputes informally
  • Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

15. Changes to Terms

  • We may modify these Terms at any time
  • Material changes will be announced via email or service notification
  • Continued use after changes constitutes acceptance
  • If you disagree with changes, you may terminate your account

16. General Provisions

  • Severability: If any provision is invalid, the remainder remains in effect
  • Waiver: Our failure to enforce any right does not waive that right
  • Assignment: We may assign these Terms; you may not without our consent
  • Entire Agreement: These Terms constitute the complete agreement between us
